Biography

Robert’s primary practice is representing and obtaining compensation for victims of traumatic brain injury, spinal cord injury, and serious orthopaedic and other injuries, as well as those who have suffered wrongful death. He represents clients throughout Ontario in cases that involve:

  • Vehicular negligence (including automobile, motorcycle, bicycle, ATV, snowmobile and boating accidents)
  • Municipal liability (negligent road design, maintenance/repair, snow, and ice removal)
  • Class actions
  • Daycare negligence
  • Nursing home negligence
  • COVID-19 business interruption insurance
  • Commercial host liability (over-service of alcohol)
  • Occupier’s liability (property owner negligence)
  • Products liability (defective consumer products causing injury)
  • Insurance claims (accident benefits, long-term disability benefits and insurer’s bad faith handling of claims)

Robert brings a unique perspective to his representation of personal injury victims having spent the early part of his legal career defending numerous large insurance companies against personal injury and other claims.  That experience, together with his prior training as a social worker, makes him highly effective in maximizing compensation for his clients and allows him to appreciate the challenges and struggles they face as a result of their life-altering injuries.

Robert is experienced and at home in the courtroom, having appeared as counsel in numerous complex and contentious jury and non-jury trials in the Ontario Superior Court of Justice, as well as on appeals in the Divisional Court, the Court of Appeal for Ontario, and the Supreme Court of Canada.

Robert understands that achieving results for his clients requires not only skill and intelligence, but also passion, creativity, perseverance, and, above all else, hard work.

Testimonials

Tracy V.

Robert Ben and his team were my Personal Injury legal team for my lawsuits from an MVA.

Experiencing personal injuries is life altering. The stress of finding a competent Personal Injury Lawyer who will advocate for your needs is so stressful and difficult. After working with another law firm in the 1st year and getting nowhere, I was referred to Rob and his team. It was night and day.

Rob’s experience and determination as well as his and his teams’ hard work allowed for success. Shouts out to Sonya and Karen (ret.) for being understanding and supportive throughout this process. I highly recommend Thomson Rogers, in particular Robert Ben and his team.

Thomson Rogers came recommended to me by a lawyer I know who works for an insurer. He said something like “this is the firm I would use because they’re the ones I find most challenging when I’m against them.” Great recommendation! I’m glad I followed it. Robert Ben and his team are professional, honest, and effective. I always felt like I knew what was happening, why it made sense, and how it would work. In the end, I got a settlement I am happy with.

I was referred to TR LAW by a friend and I’m very glad I went with them. It was a long process, but the team here answered and addressed all of my questions and concerns. Daniel Klein was very compassionate and took great care of all matters in a timely manner. He was very helpful on giving me positive input, which helped with mediations. Robert Ben guided us to a favourable settlement I am more than happy about. He kept me up to date and well informed on the process so I completely understood matters every step of the way. He was great on setting my expectations and guiding me through the final steps.

When I contacted Thomson Rogers for urgent legal assistance on short notice, Robert Ben offered his weekend, during one of the busiest times of his practice (trial prep), to immediately assist my family member. His small act was immensely helpful for my family member. His compassion as a lawyer and his dedication to the practice of law are evident in his established experience and incisive advice. I cannot express my gratitude in words. It’s a rare enough thing these days, a firm that lives up to its exceptional reputation.
