What should I do if I’ve been injured in an ATV accident?

The first thing you should do is report the accident by calling 911 and/or the police and seeking medical attention immediately. Often, police and ambulance will arrive on site resulting in some form of medical attention right away, as well as the creation of a police report. If the ATV is insured, or if you have your own car insurance, you should inform the insurer, as you may be able to claim accident benefits. Lastly, call a lawyer who can inform you of your legal rights as soon as possible.

Can I file a lawsuit if someone else caused my ATV crash?

Whether you can file a lawsuit will depend on the circumstances of the case. For example, if you operate your ATV on a public road or highway and are struck by a motor vehicle, you may be able to sue the driver and owner of that vehicle. You should always seek a legal opinion to determine what your options are and whether you have a legal claim.

Are ATV accidents covered by insurance in Ontario?

The answer to this question is complicated. ATVs operated on highways must be insured. Generally, insurance is available when an ATV is operated on an ATV park or trail. How long do I have to file an ATV accident claim in Ontario?

If a child is injured, the two-year limitation period will begin to run on the date they turn 18.
