On Friday, November 8th at the OTLA 2024 Fall Conference, Aleks Mladenovic and Deanna Gilbert, partners at Thomson Rogers, will be sharing their insights on Denman vs. Radovanovic et al., the landmark case they tried and won at the Ontario Superior Court of Justice and the Ontario Court of Appeal.
As part of the Medical Malpractice track, they will discuss “Informed Consent: Denman and Beyond.” Discussions will include:
- The importance of establishing the Plaintiff’s credibility and undermining the Defendants’ credibility in IC cases.
- The duty of disclosure in a multi-step, multi-disciplinary course of elective treatment.
- Satisfaction of the subjective element of causation when the Plaintiff is unable to testify.
