Another big win for our client, and policyholders in general!

When a fire destroyed our client’s home, a dispute arose in relation to coverage and the costs of repair to the home. The home insurer appraisers argued that the home’s indoor pool could be repaired, while our client’s appraiser found that repairs were not viable and full replacement warranted. 

An independent umpire agreed the pool needed full replacement. Under judicial review of the appraisal decision, a panel of the Ontario Superior Court of Justice (Divisional Court) ruled in our client’s favour; reinforcing that insurers can’t cut corners at the expense of policyholders.
