Supreme Court of Canada allows bank overtime lawsuits to go ahead as class actions

The Supreme Court of Canada has cleared the way for two class-action lawsuits against CIBC and Scotiabank seeking hundreds of millions of dollars for unpaid overtime to go ahead.
“The Supreme Court obviously didn’t make any ruling on the merits of whether or not these employees are entitled to overtime pay for any of the hours it is alleged they worked, but by giving clearance they’ve given some acknowledgment to the fact that the test for certification is met a little more easily than the judges said in first instance,” said Alan Farrer, managing partner of Thomson Rogers.
