In Ontario, generally speaking, you have two years from the day that you, or a reasonable person, should have discovered your claim to start your case in court. When you discovered that you might be able to bring a lawsuit is based on legislation and it’s fact specific. What you think might be the date that you discovered your case may be very different from what a court finds down the road. So, if you think you have a medical malpractice case, come talk to us as soon as you can. The sooner you get to us, the better because we have to investigate whether you have a viable claim. And that takes time.
Should I speak to my doctor first?
The number one thing that I tell our clients is You have to make decisions about your care, not thinking about whether it’s going to help you in court. You want to do what’s best for you and your health first. That being said, if you strongly suspect that you have a medical malpractice case, I think it’s better to come speak to us before directly confronting your doctor.
Is medical malpractice only related to doctors?
It can be any healthcare provider, really. Often, if it’s hospital care, there are doctors, and the hospital itself is going to get sued. Sometimes, nurses are involved, and sometimes, other professionals are involved. Physiotherapists and chiropractors are less common, but it is possible if you’ve been injured as a result of their malpractice. It all really depends on who we think is going to be responsible for the injuries that you’ve suffered.
