Our client, Mr. Vasilios (Bill) Karadimas, sustained a severe traumatic brain injury when he was hit by a car while riding his bicycle on a sunny day in 2013. Bill has no memory of the collision. Bill was 36 years old at the time. Bill’s injuries are so severe that he requires 24/7 care for the rest of his life.

The driver of the car that hit Bill had layers of insurance coverage from two different insurance companies. As the two insurers seemed to have different approaches to resolution, Darcy Merkur and Daniel Klein came up with an innovative and somewhat unprecedented strategy of settling with the Defendant’s excess insurer in the months leading up to the trial. By doing so, Bill and his family secured significant financial support for his future.

At the same time, the Defendant’s primary insurer still refused to settle within their $1 million insurance limits because of their view on responsibility for the accident. Accordingly, the Thomson Rogers team advanced the case to trial before a Toronto jury.

In October 2024, Darcy Merkur, Deanna Gilbert, and Daniel Klein secured a jury verdict that found the driver 66% at fault for the accident, resulting in the primary insurance company paying its full policy limit of $1 million plus substantial indemnity legal costs.
