What happens when medical care goes wrong?

What is Medical Malpractice?
Medical malpractice law is a law relating to any injury that a patient may suffer in the health care system, whether it’s from the care provided by a physician, a nurse, or a nurse practitioner. A typical example would be a failure to diagnose a medical condition. The patient goes to the hospital complaining of chest pain, and they’re sent home without the appropriate testing being done. It turns out that he or she had a heart attack, a heart condition, a stroke or some other significant healthcare condition that could give rise to a case of medical negligence.
What are the challenges?
We can’t succeed in a case unless we’re able to marshal expert evidence on two main issues, namely, that there was a breach of the standard of care and that the patient suffered an injury. So typically, we see patients after they have had a terrible injury or terrible event. Sometimes, it’s their family members who reach out to us, and they want to find out whether the care was appropriate and whether something could have been done differently to avoid that tragedy. We investigate those claims by obtaining their medical records, setting them off to the appropriate qualified experts, and then letting them know whether or not we can prove our case and negligence, that is, that there was a breach of the standard of care and that that breach caused their injury.
