Birth trauma cases are the most complicated cases in our area of law, namely medical malpractice. It’s a challenging and emotionally challenging area of our practice. I have the utmost sympathy for those parents. And we try to be as informative and as empathetic as we can when we’re educating them about their rights.

What do these cases entail?

Birth trauma cases typically take a long time to investigate and to litigate, given the scientific issues, the medical issues involved in proving causation. Our goal is to find the experts who understand the medicine, who can explain the medicine, and who can establish a point in time when the baby was injured and a mechanism of injury, which is often one of the most complicated parts of these cases. Many of our clients come to us years after their child’s birth. And it’s only then that they start to question the care that their child received.

What should parents know?

It’s important for a parent to ask questions of the doctors – not only the doctors who were involved in the delivery of their child, but also if their child is then sent to a tertiary center, it’s important to ask those providers what they think happened and why their child was injured. Parents should feel empowered to ask those types of questions.
