Understanding accident benefits and the compensation available in Ontario can be confusing, especially after a serious accident. In this video, Personal Injury lawyer Darcy Merkur explains the types of compensation available and why having the right legal counsel is essential to navigating the accident benefits process and securing the support you deserve.
Accident benefits are no-fault benefits available in Ontario to anyone who’s hurt in any way by a car accident. To be clear, if you’re a pedestrian hit by a car, a bicyclist hit by a car, hit by a motorcycle, if you’re impacted in any way by a motorized vehicle, in Ontario, you qualify for Ontario Accident Benefits.
If you’re injured elsewhere in North America, and you’re from Ontario, especially if you have access to your own auto policy, you can still elect Ontario accident benefits which are generally preferred throughout North America than to other jurisdictions.
What benefits are included?
Ontario Accident Benefits cover a host of different headings. They cover your income loss up to certain maximums. The maximum being $400 per week, based on 70% of your gross income before the accident. The most important benefits available through these no-fault benefits are the medical, rehabilitation, and attendant care benefits.
What happens when someone is injured?
When somebody’s injured, our job as advocates on behalf of accident victims is to help them access the most amount of benefits available. The most amount of benefits available in Ontario is if you’re accepted as having suffered a catastrophic impairment.
Why hire a lawyer?
Where people have suffered profound life-changing injuries, it’s important that you have a strong advocate in your camp to evaluate when the timing is best to advance a potential catastrophic impairment claim.
Lawyers at Thomson Rogers LLP are familiar with the catastrophic impairment test. We have extensive experience at advancing claims in that test and maximizing the chance of obtaining the designation.
